Under RCW 34.05.240, any person may petition an agency for a “declaratory order with respect to the applicability of specified circumstances of a rule, order or statute enforced by the agency.”
On February 17, 2017, WSLCB received a Petition for Declaratory Ruling, from Chief Civil Deputy Prosecuting Attorney Neil A. Caulkins on behalf of Kittitas County, on the issue of whether the Board must comply with local zoning requirements and only issue a cannabis license when the application/location is congruent with local zoning.
